Terms of Service
These Terms of Service ("Terms") govern the provision of all products and services by Advanced Floors and
Blinds ("Company") to the customer ("Client"). By accepting a quotation, placing an order, or allowing work to
commence, the Client agrees to be bound by these Terms.
1. Acceptance and Agreement
These Terms constitute the entire agreement between the Client and the Company. No variation to these Terms
shall be binding unless agreed to in writing by a director of the Company.
2. Quotations and Pricing
Validity: Quotations are valid for thirty (30) days from the date of issue unless
otherwise specified.
Scope: The quotation covers only the products and services explicitly listed. Any
additional work requested by the Client after the quote is accepted will be subject to a new quotation or
a change order, and may incur additional charges and affect the project timeline.
Hidden Conditions: The Company is not responsible for unforeseen or hidden conditions
(e.g., subfloor damage, mold, unknown plumbing/wiring, or structural issues) that are discovered after
work commences. Remedial work for such conditions will be charged separately and may delay the project.
3. Payment Terms and Deposits
Required Deposit: A non-refundable deposit of fifty percent (50%) of the total quoted
price is required and must be received by the Company before any materials are ordered or work commences.
Final Payment: The remaining fifty percent (50%) balance of the total quoted price is
due immediately upon substantial completion of the installation or service. Substantial completion is
defined as the point at which the main components of the agreed-upon work have been installed and the site
is ready for final cleanup.
Late Payment: Payments not received within seven (7) days of the due date may be
subject to a late payment charge of 1.5% per month or the maximum rate permitted by law, whichever is
less.
Title of Goods: Title to all products and materials remains with the Company until the
full balance of the invoice has been paid. Should the Client fail to pay, the Company reserves the right
to enter the premises and repossess the materials.
4. Cancellations, Delays, and Termination
Client Cancellation: If the Client cancels the contract after paying the 50% deposit,
the deposit is forfeited in its entirety to cover administrative costs, material ordering fees, and lost
scheduling time. If cancellation occurs after materials have been cut, custom-ordered, or delivered, the
Client is responsible for the full cost of those materials in addition to the forfeited deposit.
Client Delays: If the Client causes a delay to the scheduled installation (e.g.,
failure to clear the work area, premises not being ready) the Company reserves the right to charge a daily
standby fee and/or reschedule the work to a later date, subject to the Company’s availability.
Company Termination: The Company may terminate the contract immediately if the Client
fails to comply with the payment terms, poses a safety risk, or provides a work environment that is deemed
unsafe or hostile by the Company's personnel.
5. Client Responsibilities (Protecting the Company's Crew and Tools)
Access and Work Area: The Client must ensure safe and clear access to the work area and
surrounding property. The work area must be clear of all furniture, personal belongings, and fragile items
before the scheduled start date.
Existing Utilities: The Client is responsible for advising the Company of the precise
location of all concealed services (pipes, cables, etc.) prior to the commencement of work. The Company
will not be liable for damage to concealed services where no accurate plan or prior notice was provided.
Environmental Control: For flooring installations, the Client is responsible for
maintaining appropriate temperature and humidity levels within the premises before, during, and after the
installation, as recommended by the product manufacturer. Failure to do so may void the material and
installation warranty.
6. Warranty and Limitation of Liability
Workmanship: The Company warrants its installation workmanship for a period of one (1)
year from the date of substantial completion. This warranty covers issues arising directly from faulty
installation methods.
Product Warranty: Product warranties are provided solely by the product manufacturer. The
Company passes these warranties to the Client but does not offer an additional product warranty.
Exclusions: The warranty does not cover damage caused by:
Normal wear and tear, fading, or color variation.
Misuse, neglect, improper maintenance, or cleaning with inappropriate products.
Changes in moisture, humidity, or temperature outside manufacturer specifications.
Limitation: The Company's liability is limited to the repair or replacement of faulty
workmanship or the product costs (if the material itself is proven to be defective), at the Company's sole
discretion. The Company is not liable for indirect, incidental, or consequential damages, including but not
limited to loss of use, lost profits, or costs of temporary housing.
7. Disputes and Governing Law
Governing Law: These Terms shall be governed by and construed in accordance with the laws
of the [STATE/PROVINCE WHERE YOUR COMPANY IS LOCATED].
Dispute Resolution: In the event of a dispute, the Client agrees to first contact the
Company in writing to attempt to resolve the issue amicably. If the dispute cannot be resolved through
direct negotiation, the parties agree to pursue non-binding mediation before pursuing litigation.
